These Terms of Service ("Terms") govern your access to and use of the website, content, and services of PainterMed, LLC ("PainterMed," "the Practice," "we," "us," or "our"), a founder-led concierge telemedicine practice serving eligible patients in Florida, led by Michael Painter, MMS, PA-C. By accessing our website or using our services, you agree to these Terms. If you do not agree, please do not use the website or services.


1. Who May Use Our Services

You must be at least 18 years old and physically located in the State of Florida at the time of a consultation to use our telemedicine services. By using the services, you represent that you meet these requirements and that the information you provide is accurate and complete. Eligibility for any treatment is determined solely through clinical evaluation and is never guaranteed by your use of this website.


2. Not for Emergencies

Our services are not for medical emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room immediately. PainterMed does not provide emergency services, and our website and communications are not monitored for emergencies. Do not use our website, email, messaging, or booking tools to request emergency care.


3. Nature of Our Services

PainterMed provides concierge telemedicine, including clinical evaluation and, where appropriate, personalized treatment protocols with follow-up, delivered by a licensed clinician. Use of the website or booking of a consultation does not create a provider-patient relationship on its own; that relationship begins only when Michael Painter, MMS, PA-C accepts you as a patient following evaluation. Whether any therapy is appropriate for you is a clinical decision made only through that evaluation.


Some therapies discussed by the Practice may be compounded. Compounded therapies are not FDA-approved and are not reviewed for safety, effectiveness, or quality before marketing. Nothing on our website is a promise of any particular outcome; individual responses vary.


4. Educational Content Is Not Medical Advice

Content on our website and in our resource materials is provided for general educational purposes only and is not medical advice, diagnosis, or treatment. It is not a substitute for a consultation with a qualified clinician. Do not disregard or delay seeking professional medical advice because of something you read on our website.


5. Booking, Fees, and Payment

Consultations are booked through our scheduling tools. Fees, deposits, and payment terms, where applicable, are disclosed at the time of booking or during your consultation. You are responsible for any fees agreed to at booking. Any deposit terms, including whether a deposit is refundable or credited toward your visit, are described at the point of booking


6. Your Responsibilities

You agree to provide accurate, current, and complete information; to use the services only for lawful purposes; to keep any account credentials confidential; and to follow the guidance provided as part of your care. Providing inaccurate health information can affect the safety and appropriateness of any care recommended.


7. Communications and Consent to Contact

By providing your contact information, you consent to receive communications related to your care and account, including by email, phone, and, where you opt in, text message. Consent to marketing communications is not a condition of receiving care, and you may opt out of non-essential communications at any time. Our handling of your information is described in our Privacy Policy & Notice of Privacy Practices.


8. Intellectual Property

The website and its content — including text, graphics, logos, articles, and design — are owned by or licensed to PainterMed, LLC and are protected by intellectual property laws. You may view and use the content for your personal, non-commercial reference. You may not copy, reproduce, republish, or distribute our content without our prior written permission.


9. Third-Party Services and Links

We use third-party services to operate the Practice, including Google Meet for telemedicine visits and third-party scheduling, intake, and payment tools. Our website may link to third-party sites we do not control. Your use of third-party services is governed by their own terms and policies, and we are not responsible for their content or practices.

The website and services are provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the website will be uninterrupted, error-free, or secure. This disclaimer does not limit any obligations we have to you as a patient under applicable law or the standard of care governing licensed clinicians.


11. Limitation of Liability

To the fullest extent permitted by law, PainterMed, LLC and its personnel will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website. Nothing in these Terms limits any liability that cannot be limited under applicable law, including liability relating to the provision of professional health care services.
